Terms and conditions
These Terms of Use govern your access to and use of the BuildTraqr website and platform operated by BuildTraqr Pty Ltd. By using the website or signing up for the service, you agree to these terms.
Use of the service
BuildTraqr grants you a limited, non-exclusive, non-transferable right to access and use the platform for your internal construction health and safety administration. You may not use the service for any unlawful purpose or in any way that could damage or impair the platform.
Accounts and access
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
Your content
You retain ownership of the data and content you enter into BuildTraqr. You grant BuildTraqr Pty Ltd a licence to host, process and display that content solely for the purpose of providing the service to you. You are responsible for ensuring that you have the right to enter any worker, subcontractor or site data into the platform.
No warranty
The service is provided on an "as is" and "as available" basis. BuildTraqr Pty Ltd does not warrant that the service will be uninterrupted, error-free or secure at all times. To the extent permitted by law, we exclude all warranties, representations and conditions not expressly set out in these terms.
Limitation of liability
To the maximum extent permitted by law, BuildTraqr Pty Ltd is not liable for any indirect, incidental, special or consequential loss arising out of or in connection with your use of the service. Our total liability for any claim relating to the service is limited to the amount paid by you to us in the 12 months preceding the claim, or A$100 if no amount was paid.
Subscription and fees
Where the service is provided on a subscription basis, fees are payable as agreed in your order or proposal. We may change pricing for new subscriptions by providing notice. Pricing and payment terms for any early-access arrangement will be confirmed directly with each participating business.
Termination
Either party may terminate the service relationship in accordance with the agreement between us. On termination, we will make your data available for export for a reasonable period, after which it may be deleted.
Governing law
These terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.
Changes to these terms
We may update these Terms of Use from time to time. The current version will be posted on this page with an updated date. Continued use of the service after changes constitutes acceptance of the revised terms.
